RED OAK CITY ORDINANCE
CHAPTER 76 - BICYCLE LICENSING

    76.01  LICENSE REQUIRED.  No person who resides within the City shall ride or propel a bicycle on any street or upon any public pat set aside for the exclusive use of bicycles unless such bicycle has been licensed and a license plate or decal is attached thereto as provided herein.
        1.  License Application.  Application for a bicycle license and license plate or decal shall be made to the Police Department.  A license fee in an amount established by motion of the Council shall be paid to the City before each license is granted.
        2.  Issuance of License.  The Police Department, upon receiving proper application therefor, is authorized to issue a bicycle license which shall be effective immediately.
        3.  Transfer of License.  Upon the sale or other transfer of ownership of a licensed bicycle the license shall be transferred to the new owner and the records of the city changed to reflect the new ownership upon request.

    76.02  LICENSE PLATES OR DECALS.  License plates or decals are required as follows:
        1.  Issued.  The Police Department, upon issuing a bicycle license, shall also issue a license plate or decal bearing the license number assigned to the bicycle and the name of the City.
        2.  Attached to Bicycle.  The Police Department shall cause such license plate or decal to be firmly attached to the bicycle for which issued in such position as to be plainly seen from the rear.

        3.  Removal.  no person shall remove a license plate or decal from a bicycle during the period for which issued unless said bicycle is dismantled and no longer operated upon any street in the City.
        4.  Lost License.  In the event a license plate or decal shall be lost, destroyed or stolen, the owner shall report such to the Police Department immediately.  A new license shall be issued upon payment of a fee of one dollar.

    76.03  MAINTENANCE OF LICENSE RECORDS.  The Police Department shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued, and the number on the frame of the bicycle for which issued, and a record of all bicycle license fees collected.

BICYCLE LAWS & SAFE RIDING TIPS

Bicycling is a fun and healthy exercise. Before riding your bicycle on roadways, take time to learn the rules. Many bicyclists are seriously injured in accidents because they are less protected than drivers of automobiles and/or they do not practice safe riding skills.

By observing Red Oak bicycle laws and following safety rules, your bicycling will be enjoyable and more importantly, safer!  Remember, bicyclist are required to obey all the traffic laws an automobile driver must obey.

CHAPTER 75 - BICYCLE LICENSING

    75.01  SCOPE OF REGULATIONS.  These regulations shall apply whenever a bicycle is operated upon any street or upon any public path set aside for the exclusive use of bicycles, subject to those exceptions stated herein.

    75.02  TRAFFIC CODE APPLIES.  Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of the State declaring rules of the road applicable to vehicles or by the traffic code of the City applicable to the driver of a vehicle, except as to those provisions which by their nature can have no application.  Whenever such person dismounts from a bicycle the person shall be subject to all regulations applicable to pedestrians.

    75.03  DOUBLE RIDING RESTRICTED.  A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto.  No bicycle shall be used to carry more persons at one time than the number of which it is designed and equipped.

    75.04  SINGLE FILE.  Persons riding bicycles upon a roadway shall ride single file except on paths or parts of roadways set aside for the exclusive use of bicycles.

    75.05  BICYCLE PATHS.  Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway.

    75.06  SPEED.  No person shall operate a bicycle at a speed greater than is reasonable and prudent under the conditions then existing.

    75.07  EMERGING FROM ALLEY OR DRIVEWAY.  The operator of a bicycle emerging from an alley, driveway or building shall, upon approaching a sidewalk or the sidewalk area extending across the alleyway, yield the right-of-way to all pedestrians approaching on said sidewalk or sidewalk area, and upon entering the roadway shall yield the right-of-way to all vehicles approaching on said roadway.

75.08  CARRYING ARTICLES.  no person operating a bicycle shall carry any package, bundle or article which prevents the rider from keeping at least one hand upon the handle bars.

75.09  RIDING ON SIDEWALKS.  The following shall apply to riding bicycles on sidewalks:
            1.  Business District.  No person shall ride a bicycle upon a sidewalk within the Business District, or upon sidewalks adjoining any school premises.  The riding of skateboards upon sidewalks, streets and alleys in the Business District is also prohibited.  As used herein, the "Business District" is the City Square plus one block in either direction off the square and includes Fountain Square Park.
            2.  Other Locations.  When signs are erected on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person, no person shall disobey the signs.
            3.  Yield Right-of-way.  Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing.

75.10  TOWING.  It is unlawful for any person riding a bicycle to be towed or to tow any other vehicle upon the streets of the City.

75.11  EQUIPMENT REQUIREMENTS.  Every person riding a bicycle shall be responsible for providing and using equipment as provided herein:
            1.  Lamps Required.  Every bicycle when in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least three hundred (300) feet to the front and with a lamp on the rear exhibiting a red light visible from a distance of three hundred (300) feet to the rear except that a red reflector on the rear, of a type which shall be visible from all distances from fifty (50) feet to three hundred (300) to the rear when directly in front of lawful upper beams of headlamps on  a motor vehicle, may be used in lieu of a rear light.
            2.  Brakes Required.  Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement.

75.12  SPECIAL PENALTY.  Any person violating the provisions of this chapter may, in lieu of the scheduled fine for bicyclists or standard penalty provided for violations of the Code of Ordinances, allow the person's bicycle to be impounded by the City for not less than five (5) days for the first offense, ten (10) days for the second offense and thirty (30) days for a third offense.

Lubricate bearings and spindle, replace worn treads.

Keep tight, replace broken ones promptly.

Should rotate smoothly, lubricate bearings, keep axle nuts tight.

Inflate to correct pressure, which is stamped on the side wall of the tire.

Amber on front and red on rear, visible from 300 feet.
